EventUp, Inc. (“EventUp,” “we” or “us”) provides this Privacy Policy (the “Policy”) to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of www.EventUp.com (the “Site”), our mobile application (the “App”), and all services available via the EventUp Site and App (collectively, the “Services” refers to the Site, the App, and the services available through the Site and App)

This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the new Privacy Policy on the Site. You should consult this policy regularly for any changes. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our EventUp Terms of Service, accessible at http://EventUp.com/terms/.

Information Collection

We may collect information directly and indirectly from users, as well as from third parties.

Information We Collect Directly

You can browse our Site and download our App without registering. However, to use certain features or conduct certain activities (such as to create a listing, sign up to the Site or make a booking), you must be registered for an EventUp Account. In addition, we may collect other information about you when you use certain features, such as information about an event you are planning, etc.

Registration. You can register with us by creating an EventUp account, or by logging in through your social media account.

EventUp Account. To create an EventUp account, you must provide us with your name, company name (if applicable), phone number, credit card or other billing information, email address and home and venue postal addresses, as applicable.

Social Networking Account. You may also register to use the Services by logging into your account with certain third party social media or social networking services ("SNS") (including, but not limited to, Facebook). For example, if you login in through Facebook, we will ask your permission to collect your public profile information, friend list, email address, birthday and personal description. If you don’t grant us permission you can’t log-in to the Services via Facebook. Once you’ve logged in through Facebook, we may ask you for additional profile information, as noted below.

Profile and Other Information. Once you have registered with us, we may collect additional, optional information from you, including your preferences and certain demographic information, the information you choose to include in your profile, and, if applicable, any venue or event details you provide. From time-to-time, we may also run contests, surveys and promotions, and if you choose to participate we may collect additional information from you.

Information We Collect Automatically

When you visit the Site or use the App or Services, we automatically collect information about you (via cookies, log files, pixel tags, third party analytics tools, and other methods), including IP address; browser type and operating system; referring URL (or the webpage you were visiting before you came to our Site); location information; pages of our Site or App that you visit and the time spent on those pages; the links you click; information you search for; access times and dates, device ID or other identifier; language information; and other statistics.

How We Use the Information We Collect

We use the information we collect as follows:

To provide our Services, complete your transactions, fulfill your orders, respond to you, and for other customer service purposes.

To tailor the content and information that we may send or display to you, to offer location customization and personalized help and instructions, to display targeted ads on our Site and App, as well as on third party websites, and to otherwise personalize your experiences while using our Services.

For marketing and promotional purposes. For example, we may send our customers news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you.

To better understand how users access and use our Services, both on an aggregated and individualized basis, in order to improve our Services and respond to user desires and preferences, and for other research and analytical purposes.

Cookies and Tracking

We and our third party service providers use cookies and other tracking mechanisms to track information about your use of our Services. We may combine this information with other personal information we collect from you (and our third party service providers may do so on our behalf).

Do Not Track. Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of certain targeted advertising by following the instructions in the Third Party Ad Network section.

Cookies. Like many websites, we use "cookies" to collect information. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your login information for future logins. Second, we utilize session ID cookies to enable certain features of the Site, to better understand how you interact with the Site and to monitor usage and web traffic routing on the Services. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Site and Service and then close your browser. Third party advertisers on the Site may also place or read cookies on your browser. You can control how your browser accepts cookies by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Services.

Local Storage Objects. We may use Flash Local Storage Objects (“Flash LSOs”) to store your preferences and to personalize your visit. Flash LSOs are different from browser cookies because of the amount and type of data stored. Typically, you cannot control, delete, or disable the acceptance of Flash LSOs through your web browser. For more information on Flash LSOs, or to learn how to manage your settings for Flash LSOs, go to the Adobe Flash Player Help Page, choose “Global Storage Settings Panel” and follow the instructions.

Clear GIFs. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Services to, among other things, track the activities of users, and to help us manage content and compile statistics about usage. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Third-party Analytics. We use third party analytics tools, including Google Analytics, to collect, monitor and analyze this information in order to improve functionality and user-friendliness, and to better tailor the Services to our visitors' needs. Accordingly, usage data is shared with Google, which has its own privacy policy addressing how it uses such information. We encourage you to review this privacy policy to understand how Google uses such information.

Targeted Advertising and Ad Networks

We (or our third party service providers) may send users targeted ads, based on location and activities within our Site and your use of our Services. We may also participate in third-party ad networks, such as Google AdSense and allow third parties to use cookies, pixel tags and other tracking technologies to collect usage information, to display targeted ads to you on our Site and App, and on third party sites, and to track the effectiveness of advertising campaigns. These third parties may be able to associate the information they collect with other information they have about you from other sources.

Emailing Via an EventUp Account

As part of the Services, in certain circumstances, Members and Venue Owners may communicate with each other about listings and requests made through the Services, by filling out a contact form. If you disclose your email in any communication initiated through the Service, the person you are contacting may be able to email you directly. You are prohibited from using our Services to send any unsolicited commercial communications.

Information Sharing and Disclosure

Members and Venue Owners. If you create a listing, EventUp users will see the content of your listing. You can choose what information you provide as part of your listing; however, certain information is not permitted to be included in your listing. We recommend that you guard your sensitive information. As a Member, if you request a Venue Visit, request a Venue Booking Fee quote, or make a booking via the Services, we may share your name, phone number and email address with the applicable Venue Owner in order to fulfill your request or booking, as applicable.

Bookings. If you make a booking via the Services, we will share your the information we collect from you, including, but not limited to, your name and email address, as well as other information about your booking, (e.g. the number of attendees, the type of event) with the applicable Venue Owner and other Event providers, so that they can coordinate the booking with you.

Service Providers. We may employ third party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform Site-related services (e.g., without limitation, maintenance services, database management, payment processing, web analytics and improvement of the Site's features) or to assist us in analyzing how our Site and Services are used.

EventUp Partners. We may also provide personal information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you.

SNS. Members and Venue Owners may link their Accounts with certain SNS. In these instances, with your permission, we will share information about your activities within the Services, which may include your personal information and any information contained in any listings. We encourage you to read the privacy policies or statements of the other services you use.

Compliance with Laws and Law Enforcement. EventUp cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to the government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of EventUp or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity, or as evidence in litigation.

Business Transfers. EventUp may sell, transfer or otherwise share s the information it collects as one of its assets, , in connection with a merger, acquisition, reorganization or sale of assets, or in the event of bankruptcy.

Aggregate Information and Non-Identifying Information. We may share aggregated or de-identified information with third parties for industry analysis, marketing, demographic profiling and other purposes.

Changing or Deleting Your Information

All Members and Venue Owners may review, update, correct or delete the personal information in their profile by contacting us. If you completely delete all such information or otherwise delete your account, then your account will be deactivated, and you will not be able to recover your account or account information However, we may retain an archived copy of your records in our systems.

Security

We have implemented safeguards to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

International Transfer

If you are located outside the United States and choose to provide information to us, your information will be transferred to the United States and to other jurisdictions where EventUp or its service providers are located; the privacy laws in these jurisdictions may not be as protective as those in your jurisdiction. By agreeing to this Privacy Policy, you are consenting to the transfer of your personal information as described in this Policy.

Links to Other Sites

Our Site and Services may contain links to other websites, online services or applications (each a "Third Party Service"), e.g.:

Your Account may be linked to an SNS;

There may be advertisements served to you; or

You may be brought to the website of our third party payment processors.

If you click on another third party link, you will be directed to that third party's website or online service. The fact that we link to a Third Party Service is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over Third Party Services. Such Third Party Services may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other websites and online services follow different rules regarding the use or disclosure of the personal information you submit to them. Special Information for California Consumers

How we collect, use, and share Personal Information

To provide the products or features offered by Tripleseat (“Products"), including EventUp, we must process information about you, including Personal Information, whether or not you are registered or logged in. Subject to the limitations we describe in the Tripleseat Privacy Policy, we may share your Personal Information for business purposes with strict restrictions on how our partners can use and disclose the data we provide, at your direction or in ways otherwise in accordance with the CCPA. Tripleseat does not sell any Personal Information to third parties, but may share your Personal Information with service providers and other entities for business purposes consistent with the CCPA. The categories of personal information Tripleseat has collected about California consumers, during the preceding 12 months, including the categories, sources from which that information was collected, the business or commercial purpose for which it was collected, and the categories of third parties with whom the information was there shared is set forth above under the following sections: I. Information We Collect; II. How we use your information; and III. how we share your information.

Sources of Personal Information

We receive Personal Information from the information that you and others provide, from your device(s), and from our partners. The categories of sources from which we’ve collected or received Personal Information include:

  • You: We collect the content, communications, and other information you provide when you use our Products, including when you sign up for an account, create or share content, and message or communicate with others. We collect information about the people, pages, accounts, hashtags, and groups you are connected to, and how you interact with them across our Products, such as the people you communicate with the most or the groups you are part of. We also collect information about how you use our Products, including ads we serve on and off our Products, such as the types of content you view or engage with, the features you use, the actions you take, the people or accounts you interact with, and the time, frequency, and duration of your activities.
  • Other people: We may also receive and analyze content, communications, and information about you that other people provide when they use our Products, such as when others share or comment on a photo of you, send a message to you, or upload, sync, or import your contact information.
  • Your device(s): We collect information from and about the computers, phones, connected TVs, and other web-connected devices you use that integrate with our Products, and we combine this information across different devices you use.
  • Partners, vendors and third parties: Advertisers, app developers, and publishers and other partners can send us information for business purposes through the they use. We also receive information about your online and offline actions, and purchases from third-party data providers who have the rights to provide us with your information. Partners receive your data when you visit or use their services or through third parties they work with. We require each of these partners to have rights to collect, use, and share your data before providing any data to us. We also receive information from publicly available sources, research institutions and professional and non-profit groups.

How can you exercise your rights provided under the CCPA?

Under the CCPA, you have the following rights:

  • Right to Know:You have the right to request that we disclose to you the Personal Information we collect, use, or disclose, and information about our data practices;
  • Right to Request Deletion:You have the right to request that we delete your Personal Information that we have collected from you;
  • Right to Non-Discrimination:We will not discriminate against you for exercising any of these rights.

Please note that to protect your information and the integrity of our Products, we may need to verify your identity before processing your request. In some cases we may need to collect additional information to verify your identity, such as a government issued ID.

Under the CCPA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. In most cases, we will facilitate your request through automated tools available through your password-protected account.

Children

The Service is not directed to persons under 18. We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she should contact us at info@EventUp.com. If we become aware that a child under 13 has provided us with personal information, we will delete such information from our files.
